When Missourians voted to legalize adult use marijuana, the constitutional amendment authorized each dispensary’s local government to assess an additional 3% local sales tax. For many dispensaries that had a city as its local government, the surrounding county also imposed an additional 3% sales tax. The company and the rest of the legalized industry successfully sued to protect customers from this additional unlawful county tax. To the extent unlawful county sales taxes were collected between October 1, 2023 and August 1, 2025, the company is entitled to a sales tax refund.
Under Missouri law, a retailer is always responsible for paying all sales taxes, meaning it is the taxpayer and the one entitled to any sales tax refunds. Nonetheless, the company has chosen to create this voluntary refund program to allow our loyal customers to receive a benefit based on their contributions to the sales tax payments. Using this form, an eligible adult-use customer can apply for loyalty credit [or cash?], based on their applicable purchases at our retail locations that were subject to an unlawful county sales tax between October 1, 2023 and August 1, 2025.
Submission of this form does not guarantee eligibility. All submissions are subject to review. Consumers must submit proof of purchase, as directed below, by December 31, 2026 to be considered for this voluntary customer support initiative.
