What the New Farm Bill Actually Means

The recent federal Farm Bill update, signed into law on November 12, 2025, changes how hemp-derived THC products are regulated in the U.S. Especially products like Delta 8 and certain Delta 9 items. The new law closes a loophole from 2018 that allowed many unregulated and sometimes untested hemp products (often at gas stations and online shops) to stay on shelves. Now, a strict federal cap on total THC and a broader definition of hemp is in place. Licensed dispensaries that follow state rules are not impacted by these changes and can keep selling tested, state-legal cannabis to consumers. So, if you shop at a regulated dispensary, your access and safety are preserved under state law.

Why The Farm Bill Update Matters

Previously, only Delta 9 THC was counted and capped at 0.3% by dry weight. This allowed companies to synthesize Delta 8 from hemp and sell it in places where traditional cannabis was restricted. The new legislation changes this by counting all intoxicating cannabinoids together (including Delta 8, Delta 9, Delta 10, and THCA), enforcing a total THC cap of 0.4 milligrams per container, which is a major shift for the hemp industry. Most consumable Delta 8 products are now prohibited federally and are expected to disappear within a year of the law’s enactment.
